An executive session of the Borough Council of the Borough of Gettysburg will be
conducted immediately following the adjournment of this evening’s monthly general
business meeting consistent with section 708(a)(1) and section 708(a)(5) of the Sunshine
Act for the following purposes: (1) to discuss matters involving the employment and the
terms and conditions of employment of Borough employees; and (2) to review and
discuss matters of Borough business which, if conducted in public, could lead to the
disclosure of information or matters of confidentiality protected by law.
V. Approval of Agenda and Minutes – Council
A motion to approve the April 10, 2023 agenda as presented.
A motion to approve minutes of the Council Meeting of March 13, 2023; Special Meeting
(Civil Service); Public Hearing for Zoning/Event Venues; Public Hearing Zoning/Colt
Park Parcels; and the Council Work Session of March 27, 2023 as presented.

A motion to authorize the finalization and the publication for intended enactment
of a proposed ordinance amending the Gettysburg Borough Zoning Ordinance
and amending the Official Zoning Map of Gettysburg Borough for the purpose
of rezoning and reclassifying forty-nine (49) parcels of real property, located
along and adjacent to the northwestern side of Johns Avenue and the
southeastern side of Highland Avenue, by removing said parcels of real property
from the Tourist Commercial (TC) District and by adding the same to an
adjoining Low Density Residential (R-1) District.
A motion to authorize the finalization and the publication for intended enactment
of a proposed ordinance amending the text of the Gettysburg Borough Zoning
Ordinance for the purposes of establishing and regulating event venue uses
within the Borough of Gettysburg.

A motion to accept the recommendation of the Borough of Gettysburg Historic
Architectural Review Board (HARB) following its review on March 15, 2023 and grant a
Certificate of Appropriateness for the following application as presented: COA-230015
MAJOR PROJECT: 40-42 Baltimore Street (Lincoln Building) – Anita Kramer to
approve the façade improvements that are consistent with the Secretary of the Interior
Guidelines and the Gettysburg Design Guide as presented to the Board in the application
dated March 8, 2023.
A motion to authorize the execution and delivery of an Operation and Maintenance
Agreement requiring the implementation of Stormwater Best Management Practices for
certain real property in the Borough located at 138 West Broadway. Wesley Heyser,
President of Borough Council, and Sara L. Stull, Borough Secretary, are hereby
authorized to sign, attest and deliver the agreement on behalf of the Borough of
Gettysburg.

A motion to authorize the Borough Engineer to advertise the 2023 Street Improvements
project for construction bids.
A motion to adopt a resolution requesting a Flood Mitigation Program grant of $424,994
from the Commonwealth Financing Authority to be used for the Stevens Run Channel
Wall Rehabilitation, and to designate Charles R. Gable, Borough Manager and Chad
Clabaugh, Borough Engineer as the official(s) to execute all documents and agreements
between the Borough and the Commonwealth Financing Authority and assist in
obtaining the requested grant.

Borough of Gettysburg
Council Business Meeting Agenda

A motion to accept the J. P. Harris Associates Tax Exoneration report for tax year 2014
as presented.
A motion to authorize a COLA increase for retired police pensioner Craig Staley, to be
paid from the Police Pension Plan effective March 1, 2023.
A motion authorizing the Borough of Gettysburg to enter into a Cooperation Agreement
with the County of Adams for the fiscal year 2021 Community Development Block Grant
(“CDBG”) Program Administration. Rita C. Frealing, Gettysburg Borough Mayor,
Wesley K. Heyser, President of Borough Council, Charles R. Gable, MPA, Borough
Manager and Sara L. Stull, Assistant Borough Manager/Secretary, are hereby
authorized to execute the Cooperation Agreement on behalf of the Borough of
Gettysburg.
A motion to adopt a resolution appointing Janelle Wertzberger as a member of the
Gettysburg Borough Human Relations Commission for a five (5) year term of office
expiring on April 15, 2028.
A motion to appoint Judith Butterfield as a voting delegate for the PSAB Annual
Conference to be held in June.
A motion to remove a diseased and compromised sycamore tree, for public safety and
welfare purposes, from certain real property located at 445 Baltimore Street owned by
O’Shea Rentals Unlimited, Inc., as recommended by the Shade Tree Commission.
A motion to approve the Memorandum of Understanding between the Borough of
Gettysburg, O’Shea Rentals Unlimited, Inc. and the Gettysburg Borough Storm Water
Authority to remove a Sycamore Tree, remediate stream bed erosion, provide for bridge
maintenance, and to the obtain right-of-way necessary to complete the work at 445
Baltimore Street, with the responsibilities of each being articulated in the Memorandum
of Understanding.
A motion to adopt a resolution authorizing the entry into a Federal Lands Access
Program (FLAP) grant cooperative funding agreement with the Susquehanna Regional
Transportation Authority, doing business as RabbitTransit, and the Pennsylvania
Department of Transportation, relative to the funding of the construction of the
Gettysburg Gateway Connectivity Project, and further authorizing the entry into any
reimbursement agreements and related documentation as required by
PennDOT. Charles R. Gable, Borough Manager, is hereby authorized to sign, execute
and deliver any and all required documentation necessary for the grant funding of the
project.
